Most “apolitical” Americans who have paid attention to the Clinton email scandal have already concluded that Hillary was guilty of wrongdoing, and that the system was purposely and politically rigged in her favor, not to indict her.
The preponderance of evidence was overwhelming, and by any relational conclusion, there were a number of federal felonies committed by the Obama/Clinton gang, in that Obama was also aware of the unsecured emails Hillary was using, because he was exchanging correspondence with her on national security issues, which included highly sensitive and classified information.
And perhaps for that reason a federal judge on Tuesday has determined that the incoming Trump Administration and the next U.S. Attorney General can continue investigating the former Secretary of State’s emails and the issues surrounding her home-server.
The ruling by the court gives the Trump Administration the opportunity to reexamine the evidence because the current Secretary of State John Kerry had refused as the “law requires” to refer the matter over to the attorney general, instead Kerry simply allowed officials at the State Department to cherry pick which emails were relevant and which were not.
This obvious violation of federal law allowed the court to reset the judicial process thus allowing the new Attorney General Designate Jeff Session once confirmed the opportunity to reopen the investigation, if he so desires.
In a statement by President Tom Fitton of Judicial Watch, he concludes that the courts seem ”fed up with the Obama administration’s refusal to enforce the rule of law on Clinton’s emails.”
Fitton continued: “today’s appeals court ruling rejects the Obama State Department’s excuses justifying its failure to ask the attorney general, as the law requires, to pursue the recovery of the Clinton emails.”
The Trump Administration will need to decide early in 2017, if it wants to pursue the investigation and retrieve all the emails given to the Obama State Department by Clinton and her aides.
Moreover while this sounds great that perhaps justice will finally prevail, Obama still has one hand left to play, the “power of the pardon” and quite frankly he’d be a fool if he didn’t pardon Hillary, in that whatever evidence still exists, he’s a part of the cover-up.
